A costs order made against the prosecution in criminal proceedings because its failure to serve interview evidence on the defence had caused the adjournment of the trial was not quashed. The defence had also been in clear breach of the Criminal Procedure Rules 2005 by filing a certificate of readiness and by not informing the prosecution or the court until the day of the trial that the evidence had not been served, but the prosecution had failed to raise that issue at any point before the application to quash.
