Insofar as the court in Platten v Gowing (1982) 4 Cr. App. R. (S.) 386 said that a motorist could not be charged under the equivalent of the Road Traffic Regulation Act 1984 s.89 for a breach of a temporary speed limit, then such remarks were obiter. Ackner L.J.'s remark that a motorist who exceeded both a temporary and a permanent speed limit by the same act of driving could be charged with both offences was also obiter.
