In circumstances where no finding of fault had been made by the magistrates' court against a solicitors firm which had failed to discover that its purported client was a non-existent company, and there was no evidence of fault by the firm before the High Court, the court could not assume fault so as to impose the wasted costs order sought by the chief constable.
