An unsuccessful appeal against conviction arising out of a s.34 Criminal Justice and Public Order Act 1994 direction on the appellant's silence in interview that had not undermined the appellant's right to silence and so had not breached Art.6 European Convention on Human Rights. It was understood that the Judicial Studies Board specimen directions were to be revised to require that a s.34 direction included a statement that the jury could not convict mainly on the basis of a defendant's failure to speak at interview.
