[2011] EWCA Civ 1759
The court struck out a finding of contempt made against a newspaper after it had published an article that allegedly contravened an order prohibiting the identification of a child whose parents were defendants in criminal proceedings. Although the newspaper identified the defendants, it had not breached the terms of the order, which was a general licence to publish the outcome of the public proceedings in a criminal court and contained no specific restriction on identifying the defendants.
