A personal injury claim arising out of a road traffic accident would be re-tried, since the trial judge had failed, or failed adequately, to give reasons for his findings that the claimants had failed to establish a breach of duty by the insured driver or that they had suffered any harm. By implication the judge had found dishonesty and he should have given clear reasons for reaching such a conclusion.
