[2011] EWHC 1958 (Admin)

The conduct described in a European arrest warrant in respect of a conviction in Poland for driving in a state of inebriation satisfied the dual criminality test in the Extradition Act 2003 s.65(3)(b), as such conduct would amount to an offence of driving whilst unfit through drink or drugs contrary to the Road Traffic Act 1988 s.4.
