A ten year old cyclist who emerged from a side road without giving way was primarily responsible for a collision with a car but considering that he was a vulnerable road user it was just and equitable under s.1 Law Reform (Contributory Negligence) Act 1945 to reduce his damages not in accordance with his share of responsibility for the accident but by 50 per cent only.
