Redetermination appeals: Advocates Graduated Fee Scheme

Help us reduce the number of requests waiting for fee redeterminations

Following the correct process for fee redetermination requests will help us to deal with your applications more quickly.

These are now being handled within 26 days and the number waiting to be processed has reduced from 6,600 in January to around 2,000 now.

But if you remember the following points we should be able to reduce this number even further:

Use the correct AF2 form

Remember to use the correct Advocate Fee redetermination form (AF2). Version 3 is the latest form and this has been in use since 30 March 2013.

When to submit an appeal

Appeals should only be submitted when a case payment has already been made.

If a claim has been rejected before a payment has been made you should not use an AF2 form. Simply resubmit the AF1 form with the relevant amendments made.

One example is where an AF1 has been rejected because no representation order is attached. In this situation you should resubmit the AF1 and attach the missing information.

Timescale and sign off for AF2

AF2s must be lodged within 21 days of receipt of our original determination. They must also be signed by the instructed advocate.

Remember supporting documentation

A copy of the AF1 and supporting documents should be attached to the AF2.

This assists in redetermining your claim more accurately. Please ensure dates of hearings are shown on the AF1.

This information will be required should we have to contact the court.

Appealing travel costs

If appealing travel costs, ensure a full breakdown of costs/dates and any necessary receipts are provided.

Written reasons

When requesting written reasons, your letter of request must be accompanied by:

  • AF1 form ? with all supporting documents
  • AF2 form ? with any supporting documents
  • Details of all of the points you wish to raise or have addressed
