The procedures, pursuant to the Prevention of Terrorism Act 2005 s.3, relating to the supervision by the court of the making of non-derogating control orders by the secretary of state under s.2 of the 2005 Act, were incompatible with the respondent's right to a fair hearing under the European Convention on Human Rights 1950 Art.6.
