[2007] EWCA Crim 2756

A suspended term of two years' imprisonment which was activated in full to run consecutively to a 12-month sentence imposed on the appellant for attempted theft was not manifestly excessive; it was unrealistic to suppose that the judge passed the suspended sentence without regard to the time spent by the appellant in custody on remand.
