A judge's direction to the jury had made it clear that where there was no direct evidence of any crime the prosecution had to prove that cash in the possession of a defendant charged under the Proceeds of Crime Act 2002 s.328(1) represented the proceeds of earlier crime and that the defendant had known or suspected that fact.
