[2008] EWCA Crim 2870

A judge had erred in imposing a sentence of 10 years' imprisonment in default of payment of a confiscation order where the offender's criminal proceeds and realisable assets only just exceeded the £1 million band. In the circumstances, the appropriate sentence in default of payment was six years' imprisonment.
