[2012] EWCA Crim 2332

The minimum term in the Powers of Criminal Courts (Sentencing) Act 2000 s.111 should not be the starting point of the sentencing exercise. A sentencing judge should go through the proper sentencing exercise in accordance with the sentencing guidelines and then cross-check to ensure that the sentence was no less than the minimum term required.
