Where a defendant sought to rely on the defence provided by the Immigration and Asylum Act 1999 s.31(1) , and the defendant could adduce sufficient evidence in support of his claim to refugee status to raise the issue, the prosecution bore the burden of proving whether or not he was a refugee.
