[2012] EWCA Crim 2127

Fines totalling £100,000 imposed following convictions for four counts of supplying articles for use in fraud, namely two annual first-class rail-travel passes, were replaced with fines totalling £20,000 in order to reflect the offender's means and the level of criminality involved, where the sentencing exercise performed by the original judge had been seriously deficient, and the appellate court's sentencing powers had been constrained by the Criminal Appeal Act 1968 s.11(3) because of his approach.
