Although a non-custodial sentence would be very rare for an offence involving an imitation firearm, where an offender, fearing self-harm, had packed it in a bag to hand in to medical staff, the circumstances were so wholly exceptional that a custodial sentence, even if suspended, was manifestly excessive.
