[2004] EWCA Crim 83

Where a codefendant had lied to the police in the presence of the defendant, and the defendant had not corrected that lie, the issue of whether the defendant had adopted the lie could only be left to the jury if there was further evidence and a direction that the jury should consider whether a correction had been required.
