[2004] EWCA Crim 593

Where a defendant had been led to expect that a particular sentence, namely a drug treatment and testing order, would be passed if a particular condition could be complied with, and it was subsequently shown that it could be, then the judge was bound to pass that sentence unless the judge had made it clear that prison would remain a viable option.
