[2009] EWHC 2359 (Admin)

Under the Criminal Justice Act 2003 s.255A(5), an offender recalled to prison while on licence would only be suitable for automatic release if the secretary of state was satisfied that they would not present a risk of serious harm to members of the public if released at the end of the 28 day period specified by s.255A(4).
