It was not clear that if a jury could have foreseen the subsequent conduct of a key witness, which cast doubt on her credibility, it would have reached a different conclusion about the evidence, and accordingly it was not shown that there had been a miscarriage of justice for the purposes of the Criminal Justice Act 1988 s.133(1).
