Magistrates had been entitled to refuse to order a police commissioner to pay an individual's costs of successfully defending forfeiture proceedings brought against her under the Proceeds of Crime Act 2002 s.298 . The only option to the police had been to make the forfeiture application and they should not have been deterred from doing so because of concerns about their liability for her costs.
