A judge had been entitled to extend the custody time limits of a remand prisoner, as the Crown had acted with due diligence and expedition in obtaining an expert report in relation to his fitness to plead. It was common practice for the Crown to wait until a defendant had served the two medical reports required before instructing its own expert, and there was a potential considerable saving in cost in adopting that practice.
