The extradition of a suspect did not amount to an abuse of process in circumstances where she was due to stand trial for an offence of assisting an offender in a matter in which she had previously been charged with murder by the requesting state. Although there were facts common to both allegations, they were two different offences requiring proof of different things and the double jeopardy principle was not engaged.
