In a case concerning an offence of driving whilst over the prescribed alcohol limit, a magistrates' court was entitled to admit a hearsay statement of a blood sample analyst through the mechanism provided by the Criminal Justice Act 2003 notwithstanding that notice had been given pursuant to the Road Traffic Offenders Act 1988 s.16(4) requiring the attendance of the analyst.
