An owner of lorries over which an order of deprivation was made under the Powers of Criminal Courts (Sentencing) Act 2000 s.143, following criminal offences committed by the drivers of the vehicles, was entitled to have the lorries returned. The owner had a right to bring civil proceedings for conversion to which the police would have no defence.
