Perjured evidence could be treated as that of a company, even where it was neither procured or knowingly adopted by the company nor given by someone who was part of the company's directing mind and will, nor a person to whom the conduct of the litigation had been delegated, if the act of the person giving it was intended to count as the act of the company. Judgment obtained through perjured evidence given by a vital witness would be set aside.
