PUBLISHED March 13, 2006
SHARE

The court could not order mediation or actively participate in settlement negotiations where there was a refusal by one of the parties to have their dispute mediated. The court protected its own position and that of other litigants before it by the ultimate sanction of costs in the event that the refusal was unreasonable.
