In the circumstances it would not be contrary to the interests of justice to return the applicant, who had been convicted in Italy of murder and kidnapping, to that country under the Extradition Act 1989 s.12 where he had been absent by choice from the Italian proceedings by which he had been convicted and an extradition crime within s.2 of the Act had been established.
