[2001] EWHC Admin 450

A road between the mainland and an island was not held to be a public place within the meaning of s.5(1)(a) Road Traffic Act 1988 because it only had occasional visitors. In addition, a man waiting in his car with the engine running was to be regarded as "a man driving his car".
