The detention regime enshrined in the Police and Criminal Evidence (Northern Ireland) Order 1989 art.43 did not apply to those who had been committed for detention under the Magistrates' Courts (Northern Ireland) Order 1981 art.47(4A), and therefore the fact that the continued detention of two remand prisoners who had been detained under art.47(4A) had not been authorised in accordance with that regime did not render their detention unlawful.
