A policy of indefinite retention of fingerprints, photographs, DNA samples and DNA profiles of persons convicted of a recordable offence which had the legitimate aim of crime prevention and the detection of criminals was not a disproportionate interference with the person's private life under the European Convention on Human Rights 1950 art.8 merely because it failed to have regard to the gravity of the offence, the offender's likelihood of reoffending or the likelihood of the data assisting in the detection of future offending.
