There were no bars to the extradition to Spain of an individual accused of terrorist offences and extradition was not incompatible with his human rights. Spain was a contracting party to the European Convention on Human Rights 1950 and had to be presumed capable of protecting the human rights of those under its control and of providing adequate remedy in the event of any breach, and it was for the Spanish courts to decide whether the offences were proved.
