[2009] EWHC 2740 (Admin)

An accusation that an extradition request governed by the Extradition Act 1989 was made in bad faith pursuant to s.11(3) remained a continuing accusation that triggered consideration of whether it would be just to return the individual, and it was necessary to consider the issue of bad faith despite the fact that the requesting state had since become a member of the European Union and could be relied upon to conduct a fair criminal trial.
