Where a criminality was best described by reference to the nature of the activity rather than particular methods, a description of the nature of the activity was sufficient notice to an individual that any conduct falling within that description was criminal. Section 38(3) and (4) Dangerous Drugs Act 1986 (Mauritius), which increased the penalties for a finding of trafficking, envisaged that a finding of trafficking would be made at the stage of the accused's conviction by the trial court.
