A European arrest warrant issued for an offence of accepting for the purpose of making profit three music CDs and a number of film and computer program discs, produced in breach of copyright, could not stand as the offence was not an extradition offence. It was not a criminal offence under the Proceeds of Crime Act 2002 s.329, or under the Copyright, Designs and Patents Act 1988 s.107(1)(c) because it was not inevitable that the possession was "in the course of a business".
