A 180 hour community punishment order imposed for causing death by dangerous driving was unduly lenient and a sentence of two years would have been appropriate at first instance. However, the sentence would not be varied as, given that the defendant had completed 106 hours of his punishment order and taking into account double jeopardy, there would be little benefit in sending the defendant to prison for such a short period of time.
