There was no public law duty on the Home Secretary to provide a reasonable opportunity to the subject of a non-derogating control order to demonstrate a reduction in the risk which he posed. The control order regime was not analogous to that in respect of prisoners sentenced to imprisonment for public protection because the latter was not subject to the statutory framework for controlled persons under the Prevention of Terrorism Act 2005.
