Taking an unusual course to end the matter, the court exercised afresh the discretion of the district judge to determine that a defendant to aborted criminal charges who had been refused his costs was entitled to a smaller amount of money from central funds pursuant to the Prosecution of Offences Act 1985 Pt II for costs properly incurred between his arrest and the discontinuance of proceedings.
