There was no absolute embargo on the admission of hearsay evidence under the European Convention on Human Rights 1950 Art.6 and no rule that a statement could not be adduced in evidence unless a defendant had the opportunity to examine the witness. In the interests of justice the trial judges had been right to allow the prosecution to adduce witness statements in evidence under the Criminal Justice Act 2003 s.116.
