[2012] EWHC 1733 (Fam)

Disclosure of documents relating to a former husband's finances which contained information received under the Mutual Legal Assistance regime was ordered where the documents were clearly necessary for the fair disposal of the former wife's application to set aside an ancillary relief order on the basis of his material non-disclosure, fraud and misrepresentation. The undoubted public interest in supporting the regime did not outweigh the public interest in the evidence being available to the court.
