Where an accused sought to contend that his extradition to a Category 2 territory was barred under the Extradition Act 2003 s.82 by reason of the passage of time it was incumbent on the courts to apply the statutory test contained in s.82 of the Act and to examine the circumstances which led to the fact that the accused was not facing justice in the extraditing country.
