The Secretary of State for Justice was in breach of his public law duty by failing to provide relevant offending behaviour courses to allow prisoners serving indeterminate sentences for public protection to demonstrate to the Parole Board by the time of the expiry of their minimum terms that their detention was no longer necessary for the protection of the public.
