When regard was had to the Police and Criminal Evidence Act 1984 Code C paras.10.1 and 11.1(A) a necessary precondition for the administration of a caution was that there had to be grounds for the suspicion of a criminal offence. The decision as to whether there were grounds to suspect was essentially one for the Magistrates' Court subject to the appellate authority of the High Court.
