An 18-month custodial sentence imposed on a defendant who had pleaded guilty to an offence of assault falling within Category 2 of the Sentencing Council's Definitive Guidelines for offences of assault was harsh but not manifestly excessive. In view of the number of aggravating features, justice would not have been reflected in the identified category range of sentence and the sentencing judge had therefore been justified in moving outside it.
