A conviction for conspiracy to supply cocaine was quashed where the judge's directions had allowed the possibility that the defendant and the other alleged conspirators could be convicted without the jury necessarily being sure that they were all guilty of the same conspiracy. The prosecution always had to consider carefully how to formulate a conspiracy charge and whether a substantive offence would be more appropriate.
