The court examined sentencing considerations for offences under the Child Abduction Act 1984 in a familial context. It invited the Law Commission to address the question whether cases where children were removed from one parent by the other should be treated as kidnapping offences and, pending any possible change to the substantive law, recommended that the maximum sentence for child abduction, that of seven years' imprisonment following a trial, should be increased.
