Following R v (1) Burge (2) Pegg (1995) 1 Cr App R 163, a direction as to lies should be tailored to the circumstances of the case. It was sufficient to direct that the lie must be proved beyond reasonable doubt, and that the mere fact that a defendant lied was not in itself evidence of guilt since defendants may lie for innocent reasons, so only if a jury was sure that the defendant did not lie for an innocent reason could a lie support the prosecution case.
