A decision to extradite an Algerian national to France was quashed where the Secretary of State for the Home Department had failed to address issues concerning allegations that the applicant had been named by a witness subjected to brutality during interrogation. Further, the principle of fairness had been breached because the secretary of state had considered materials not available to the applicant.
