[2007] EWCA Crim 2105

A judge had erred in admitting evidence of the guilty pleas of a co-defendant after failing to properly balance considerations of unfairness under the Police and Criminal Evidence Act 1984 s.78 and failing to address the consequences of adducing evidence that had effectively closed off live issues being tried by the jury.
